1. Agreement to Terms

These Terms & Conditions (the "Terms") constitute a legally binding agreement between you and DBS Capital DBA Pressure Washing MC ("Company", "we", "us", or "our") regarding your access to and use of our website and services (the "Services"). By using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old and have the authority to enter into these Terms. If you request services on behalf of a third party or entity (e.g., HOA), you represent that you are authorized to do so.

3. Service Descriptions; Estimates

• We provide exterior cleaning services, including pressure washing and soft washing for residential and commercial properties. Specific methods and detergents are determined by our technicians based on surface type and condition.
• Quotes may be provided via phone, text, email, or in person. Unless otherwise stated, quotes are estimates based on the information available and may be adjusted upon site inspection or if conditions differ materially.
• Property Access: You agree to provide clear access to the work areas and a functional water spigot and electricity if required. Please secure pets and remove vehicles or fragile items as needed.
• Pre-Existing Conditions: We are not responsible for pre-existing damage, defective surfaces, loose paint, failing grout, oxidized siding, or other conditions that may be revealed during cleaning.

4. Scheduling, Cancellations, and Rescheduling

• We will coordinate a service window and communicate updates. Weather, safety, or equipment issues may require rescheduling.
• Please give at least 24 hours’ notice for cancellations or rescheduling. A cancellation fee may apply for same-day cancellations or no-shows where our crew is en route or on site.

5. Pricing, Deposits, and Payment

• Pricing is stated before work begins. Taxes and fees may apply. Deposits may be required for large or commercial projects.
• Unless otherwise agreed, payment is due upon completion. We may accept cash, card, or other methods as communicated. Late balances may accrue fees and collection costs.

6. Customer Responsibilities

• Remove or cover delicate items (e.g., outdoor furniture, electronics), ensure windows and doors are closed, and notify us of known issues (e.g., leaks).
• Fragile or specialty surfaces (e.g., old wood, oxidized siding, soft stone, painted murals) may require additional care or may not be serviceable.

7. Safety and Environmental Practices

• We follow industry practices for safe pressure and detergent use and take reasonable steps to protect landscaping and surfaces. Some runoff is unavoidable. Please inform us of any environmental restrictions or sensitive areas.
• Keep children and pets away from work areas while equipment is operating.

8. Satisfaction and Limited Warranty

• We want you to be happy with the results. If you have concerns, contact us within 48 hours so we can evaluate and, if appropriate, address them.
• Except as expressly stated, the Services are provided "as is" without warranties of any kind, express or implied.

9. Disclaimers and Limitation of Liability

• To the fullest extent permitted by law, we disclaim all warranties not expressly stated. We are not liable for indirect, incidental, special, consequential, or punitive damages.
• Our total liability for any claim related to the Services will not exceed the total amount you paid for the specific service giving rise to the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its personnel from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Services or breach of these Terms.

11. Intellectual Property

The website design, logos, text, and content are owned by the Company or its licensors and are protected by law. You may not copy, distribute, or create derivative works without our prior written consent.

12. Photos, Videos, and Reviews

With your permission where required by law, we may capture before/after photos or videos of work we perform and may use them for quality assurance, training, or marketing. You grant us a non-exclusive, royalty-free license to use any voluntarily provided reviews or testimonials, subject to your privacy rights.

13. Third-Party Links and Services

Our website may link to third-party sites and services (e.g., scheduling, payments, social media). We are not responsible for their content or practices. Their terms and privacy policies govern your use of those services.

14. Communications; SMS Consent

• By submitting a quote request, you consent to receive service-related communications (e.g., scheduling, confirmations, reminders) by phone, email, or SMS. Message and data rates may apply. You can opt out of SMS at any time by replying STOP.
• Promotional SMS or calls will only be sent with your express consent where required. You may opt out at any time.
• Consent to receive marketing SMS is not a condition of purchase. Message & data rates may apply. Reply STOP to opt out and HELP for help.

15. Governing Law; Dispute Resolution

• These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
• Before filing a claim, the parties will attempt to resolve disputes in good faith within 30 days after written notice. If unresolved, disputes may be brought in the state or federal courts located in Orange County, Florida, and the parties consent to jurisdiction and venue there. You and we waive jury trial to the extent permitted by law.

16. Severability; Waiver

If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver.

17. Assignment

You may not assign these Terms without our consent. We may assign them as part of a merger, sale, or reorganization.

18. Force Majeure

We are not liable for delays or failures due to events beyond our reasonable control, including weather, acts of God, labor disputes, or supply interruptions.

19. Changes to the Terms

We may update these Terms from time to time. The updated Terms are effective when posted, as indicated by the "Last updated" date.
